Pool Safety Inspections – What You Need to Know

Planning to buy or sell your house? Do you have a pool included the property? It is then mandatory for you to abide by the laws regarding pool safety inspections in order to meet NSW regulations.

Most homeowners come to fail pool safety inspections owing to a few reasons:-

  1. Gate latches or hinges are not complaint
  2. Fences are not designed according to Australian Standards
  3. Gaps in fence are more than 100 mm
  4. There is a climbable barrier/fence
  5. No swimming pool safety signs visible
  6. Trees and other objects near the fence can be climbed

You need to make sure your pool adheres to all the stated safety standards. To prepare your pool for the same, here is what you can do.

  • Does my fish pond need a fence?

As long as the structure is only being used as a fish pond, there will be no need for a child safety barrier or an inspection. It will however be a great idea to get a safety mesh installed in order to restrict the kids.

  • Will my spa need a fence?

An indoor bathroom bath spa is not considered a pool under any regulations. An outdoor spa will though not be deemed as a pool, but it will need a fence if covered with a suitable lockable spa cover.

  • Does my portable pool or blow-up need a fence?

Yes, it will have to comply with the Australian Standards.

  • What if there is an existing exemption for pool fencing?

Yes, but if you have made any substantial changes or have decided to fence the pool voluntarily, then the pool might be subject to inspections while ensuring the barrier meets all current regulations.

  • Is Child Safety the Government’s responsibility?

No. The government sets the law and writes the regulations regarding all safety inspections. It is the pool owner who has to take full responsibility to ensure the pool is compliant with the rules and that all children are properly supervised around the pool.

  • I don’t think I need a pool inspection. Is it mandatory?

Getting an inspection done is always a great idea, especially if you are planning to lease or eventually sell the property.

  • Is there a possibility of a private pool safety inspection?

Yes. Private certifiers are empowered to issue compliance certificates; local councils can hold pool safety inspections.
